I agree to pay the Wyatt Violin Shop a monthly payment of $_______ per month, or $______ for each ___ month payment period. I reserve the right to return the merchandise at any time without further obligation. 2. That the rental fees will be applied toward the purchase and that full title and ownership of the item will remain with the Wyatt Violin Shop until full payment has been made. Accrued rent may be applied up to 50% of the purchase price of this or any other instrument offered for sale by the Wyatt Violin Shop. 3. That I will not sell, mortgage, or dispose of the item until full payment has been made. 4. That the Wyatt Violin Shop and its representatives may pick-up the item from school or home if the monthly payments are not kept current. 5. The Wyatt Violin Shop reserves the right to charge security reference credit cards listed on this contract for payment in the event that any account falls past due more than 45 days. The renter agrees to lease the instrument as provided herein.

Rental Payments – The renter agrees to pay the Wyatt Violin Shop in advance for the initial rental period which includes a rental fee, tax, and service agreement (optional). Rental fees are non-refundable. All payments for rent beyond the initial rental period are due on the same day each month. Payment will be applied first to late fees and any other charges due and then to the instrument lease. Payments are applied to past due payments first then to current payments.

Late Charge – A late Charge of $5.00 per month is charged on any payment that is more than 10 days past due.

Default – If the renter defaults on any monthly payment, the Wyatt Violin Shop may assume the renter does not wish to continue the trial purchase agreement, and may reclaim the instrument whenever found at school or elsewhere, with or without the knowledge of the renter. If legal action becomes necessary to recover the instrument, the renter agrees to pay reasonable legal fees. The renter hereby directs any third party having custody or possession of the instrument, including schools, to deliver the instrument to the Wyatt Violin Shop representative on demand and agrees to hold the Wyatt Violin Shop, the said third parties, school officials, and teachers harmless for such delivery. In the event the instrument is repossessed by the Wyatt Violin Shop the renter will pay, in addition to the cost of collection and instrument damage, all amounts due under the contract from the date hereof until recovery of the instrument by the Wyatt Violin Shop. There will be an automatic collection fee of $50 assessed at the time the account is turned over to collection. If the renter fails to make the monthly payments on the date specified on the contract, the renter must return the instrument immediately to the Wyatt Violin Shop location listed on the contract.

Trial Purchase – On pre-rented instruments, the Wyatt Violin Shop will apply paid rent (minus sales tax) as specified on the rental contract, for the specific instrument rented, toward the price then in effect of a new like instrument purchase. Exchanges may be made anytime for moving up in size due to a recommendation by a teacher or when agreed upon by the Wyatt Violin Shop and the renter.

Returns – Instruments may be returned any time throughout the rental period without further obligation. Payments must be current at the time of return. Any equipment that was furnished with the instruments must be returned. Example: case, bow, rosin, etc.

Service Agreement – Included in Contract

Service – All adjustments and repairs will be made to keep the instrument in proper playing condition. Work must be performed by the Wyatt Violin Shop technicians.

Repair – For regular maintenance during the rental contract, the instrument will be restored to good playing condition. Minor case repairs, latches, hinges, etc. are covered.

Coverage does not include – Replacement of strings, removal of minor dents that do not affect playing quality, or destruction. All repairs, parts and replacement must be handled by the Wyatt Violin Shop. No reimbursements will be made for service or parts procured from other sources. Loss by fire or theft is not covered by this service agreement; the renter is responsible for the loss of the instrument and is liable for full payment in this event.
